§ 28-3. Scope.
(a)
Any of the following that occur after October 20, 1988 are subject to all applicable regulations in the chapter:
(1)
The erection of any new building or structure.
(2)
A change in the use of any lot, building or structure.
(3)
The alteration of any building or structure.
(b)
To avoid undue hardship, nothing in this chapter shall be deemed to require a change in the plans, construction, or designated use of any building or structure on which actual construction was lawfully begun prior to the effective date of adoption, or amendment of the ordinance under which construction was lawfully commenced, provided that construction shall be completed within three hundred sixty-five (365) days of such effective date and be subject thereafter to the provision for nonconforming uses in this chapter.
(c)
The adoption of this chapter shall not limit the construction of any building or structure for which a zoning compliance permit had been obtained before the effective date of adoption or amendment of the ordinance under which construction was lawfully commenced even though such building or structure does not conform to the provisions of this chapter, provided that work shall commence and be carried on within thirty (30) days of obtaining such permit and be subject thereafter to the provisions for nonconforming uses in this chapter.
