§ 17-113. Abatement of nuisance.
Where an owner or occupant of an unpaved or partially paved parcel of land within the city is using or maintaining such parcel in a manner that constitutes a public nuisance, the city manager or his duly authorized representative shall notify the owner or occupant in writing to take steps to abate such nuisance within five (5) days after service by registered mail of such notice upon him. If abatement does not commence or occur within that period, the city manager or his duly authorized representative shall cause such abatement to occur. The cost to the city of whatever dust control measures are necessary to abate the nuisance shall be billed to the owner or occupant of the property. In the event the owner or occupant of such property fails to pay such bill within thirty (30) days after the same has been rendered, the city manager or his duly authorized representative shall report same to the assessing officer of the city, who shall then assess the cost of abatement against the property upon which the nuisance was located, such assessment to be collectible in the same manner and in all respects as provided by law for the collection of taxes by the city.
